Carbert Waite student-at-law, Kate Perala, recently co-authored a piece on ABlawg.ca where she offered her insights into a decision surrounding private healthcare.
Published on the University of Calgary Faculty of Law’s blog, Kate and her co-author Dr. Lorian Hardcastle, comment on Cambie Surgeries Corporation, et al v Attorney General of British Columbia, et al, 2023 CanLII 26745, which addresses the constitutionality of BC’s limits on private health care. On April 6, 2023, the Supreme Court of Canada (SCC) dismissed an application for leave to appeal the decision of the matter.
The authors argue that while the decision was not the victory that proponents of public health care had hoped for, it still provides support for provinces to enforce limits on private finance in health care which protect their federal health transfer payments. The article also examines the potential implications of the decision for the future of health care in Canada and highlights the need for continued vigilance and improvement in public health care.
