Employee performance can be impacted by a number of factors. The most common ones include health issues, competency issues, changes to responsibilities and reporting relationships, and experiencing harassment in the workplace. We can guide employers and employees through performance management processes with a goal of returning employees to full participation and productivity.

 

If circumstances escalate we can advise on discipline processes up to and including terminations for just cause.

 

When changes are occurring in the workplace which require changes to compensation structures, roles, responsibilities and reporting relationships we can advise employees and employees regarding the possibility of constructive dismissal.

 

When the employment relationship terminates,

 

we can advise on severance packages including the reasonable notice period, what elements of compensation should be included in the severance package, and what structure might be appropriate for the severance package in the circumstances.
