Mediation Services

Mediation is a form of alternative dispute resolution that entails a less formal approach compared to arbitration or trial, where a neutral third party, the mediator, facilitates communication and negotiation among disputing parties. The mediator does not render decisions or enforce solutions but aids the parties in identifying issues, exploring potential resolutions, and reaching a mutually agreeable outcome.

Mediations are confidential, and the process is voluntary, meaning that all parties must agree to participate. It offers several benefits, including:

  • Cost-effectiveness
  • A faster resolution compared to litigation
  • The opportunity for parties to have more control over the outcome
  • The opportunity for parties to reach a resolution of the matter or matters in a dispute without proceeding to trial

We believe in a flexible approach to mediation. The process should be adaptable and suit the needs of the parties and the nature of the particular dispute.

The Role of a Mediator

As mediators, we are prepared to play a facilitative role or to engage on the facts and the law as much as is necessary and desired by the parties. We value the role that counsel plays in mediation and always respect their relationship with their clients.

The primary role of the mediator is to create an atmosphere where the parties can come to their own unique resolution. Creativity and persistence in facilitating discussions and guiding the parties to a mutually acceptable settlement are key factors in the mediation process.

Michael Waite K.C. has 25 years of experience in general commercial and civil litigation and is comfortable conducting mediations and arbitrations in a wide variety of subject matter areas. His most significant areas of practice expertise would be in:

  • Serious personal injury/medical malpractice (involving catastrophic injuries).
